You have 90 days to submit your bond/trust/insurance information to the FMCSA from the date of your filing! Basically, if you have not filed all your paperwork within 90 days, your application will be dismissed and you have to start all over, with potentially additional costs and extra steps that you might have to take.

What is a Dismissal?

If the FMCSA dismisses you, it generally means your application for operating authority was denied because you failed to provide required documents like proof of insurance (Liability for a Carrier, or Bond/Surety Trust for a Broker) or a Form BOC-3 within a certain timeframe. It is equivalent to a rejection of your application. Starting an “un-dismissal” is essentially starting again with a completely new application and jumping through some additional hoops to prove to the FMCSA that you are serious.

If you were dismissed by the FMCSA for not filing your bond paperwork on time, don’t panic — you may still have a path to get undismissed. Acting quickly is key. Once your bond, trust or insurance paperwork is properly filed and all requirements are met, you then submit a request to have your authority reinstated. While the process isn’t automatic, many carriers and brokers are able to get back in good standing if they resolve the issue promptly. Time matters, so don’t delay — getting back on the road starts with getting your paperwork in order.

  1. Here are the steps required to have your brokerage undismissed by the FMCSA:
    • Prepare Your Documents (Your BOC-3 will be submitted after undismissal)
    • Complete the Undismissal Application
    • Pay the $650.00 fee here
  2. Secure Financial Compliance
    • Obtain a $75,000 surety bond or BMC-85 Trust Fund – Apply for a BMC-85 here

    • Tier 1 – Initial Screening – FMCSA reviews application for completeness; issues Materially Incomplete Notice if needed
